The best way to minimize law enforcement
liability exposure is to proactively maximize the level of agency professionalism.
By focusing on professionalism, an agency can reduce, or eliminate, the
root causes of liability, while simultaneously providing a higher level
of law enforcement services to the community served.

LERM is accurately assessing and responsibly
managing the foreseeable risks of providing law enforcement services,
analyzing how these risks can be controlled, providing risk transfer mechanisms
where feasible, providing competent management practices to reduce the
risk exposures, providing training and resources to all agency levels,
including the street officer, and carefully managing the aftermath of
potentially liability generating incidents.
LERM
is Not Just "Scare Tactics Without Solutions
LERM is more than mere scare tactics
to coerce an agency into taking some form of action. An agency cannot
be prohibited from taking some form of action without providing the agency
with realistic alternatives for achieving their goals.
The
Importance of Information
The single most important answer to LERM
is information - accurate, up-to-date, and thorough information. Being
served with a lawsuit is NOT the best time to learn that you have an exposure
within your agency. Or, finding out at trial that you have the WRONG expert
- is not a pleasant experience. Accurate, thorough, competent information
is the backbone of effective law enforcement risk management.
